general principles
The CPC is the vanguard of the Chinese working class, the vanguard of the Chinese people and the Chinese nation, the leadership core of the cause of socialism with Chinese characteristics, representing the development requirements of China's advanced productive forces, the direction of China's advanced culture, and the fundamental interests of the overwhelming majority of the Chinese people. The highest ideal and ultimate goal of the Party is to achieve communism.
The Communist Party of China takes Marxism Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the Important Thought of the Three Represents, the Scientific Outlook on Development, and Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era as its action guidelines.
Marxism Leninism reveals the laws of the historical development of human society, and its basic principles are correct and have strong vitality. The highest ideal of communism pursued by the CPC can only be realized on the basis of the full development and highly developed socialist society. The development and improvement of the socialist system is a long-term historical process. By adhering to the basic principles of Marxism Leninism and following the path chosen by the Chinese people of their own free will and suited to China's national conditions, China's socialist cause will surely win the final victory.
The CPC, with Comrade Mao Zedong as its main representative, combined the basic principles of Marxism Leninism with the concrete practice of the Chinese revolution and founded Mao Zedong Thought. Mao Zedong Thought is the application and development of Marxism Leninism in China, the correct theoretical principles and experience summary on Chinese revolution and construction that have been proved by practice, and the crystallization of the collective wisdom of the CPC. Under the guidance of Mao Zedong Thought, the CPC led the people of all ethnic groups throughout the country to win the victory of the new democratic revolution and establish the People's Republic of China under the people's democratic dictatorship after a long-term revolutionary struggle against imperialism, feudalism and bureaucrat capitalism; After the founding of the People's Republic of China, socialist transformation was smoothly carried out, the transition from new democracy to socialism was completed, the basic socialist system was established, and socialist economy, politics, and culture were developed.
Since the Third Plenary Session of the Eleventh Central Committee, the CPC, with Comrade Deng Xiaoping as the main representative, has summarized the positive and negative experiences since the founding of New China, emancipated the mind, sought truth from facts, realized the shift of the work center of the whole party to economic construction, implemented reform and opening up, opened a new era for the development of the cause of socialism, gradually formed the line, principles and policies for building socialism with Chinese characteristics, clarified the basic issues of building socialism, consolidating and developing socialism in China, and founded Deng Xiaoping Theory. Deng Xiaoping Theory is the product of the combination of the basic principles of Marxism Leninism and contemporary Chinese practice and the characteristics of the times. It is the inheritance and development of Mao Zedong Thought under the new historical conditions, a new stage of the development of Marxism in China, a Marxism in contemporary China, and the crystallization of the collective wisdom of the CPC, guiding the socialist modernization cause of China to move forward.
Since the Fourth Plenary Session of the Thirteenth Central Committee, the CPC, with Comrade Jiang Zemin as the main representative, has deepened their understanding of what socialism is, how to build socialism, what kind of party to build, and how to build the party in the practice of building socialism with Chinese characteristics, accumulated new valuable experience in governing the party and the country, and formed the important thought of "Three Represents". The important thought of "Three Represents" is the inheritance and development of Marxism Leninism, Mao Zedong Thought and Deng Xiaoping Theory. It reflects the new requirements of the development and changes of the contemporary world and China on the work of the Party and the state. It is a powerful theoretical weapon to strengthen and improve Party building and promote the self-improvement and development of socialism in China. It is the crystallization of the collective wisdom of the CPC and the guiding ideology that the Party must adhere to for a long time. Always adhering to the "Three Represents" is the foundation of our party's founding, governance, and strength.
Since the 16th National Congress of the Communist Party of China, the CPC, with Comrade Hu Jintao as the main representative, has adhered to Deng Xiaoping Theory and the important thought of "Three Represents" as the guidance, according to the new development requirements, deeply understood and answered the major questions of what kind of development to achieve under the new situation, how to develop, and formed the scientific development concept of people-oriented, comprehensive, coordinated and sustainable development. The Scientific Outlook on Development is a scientific theory that comes down in one continuous line with Marxism Leninism, Mao Zedong Thought, Deng Xiaoping Theory and the important thought of "Three Represents" and keeps pace with the times. It is a concentrated embodiment of the Marxist world outlook and methodology on development, a major achievement of the sinicization of Marxism, a crystallization of the collective wisdom of the CPC, and a guiding ideology that must be adhered to for a long time to develop socialism with Chinese characteristics.
Since the 18th National Congress of the Communist Party of China, Chinese Communists with Comrade Xi Jinping as the main representative have conformed to the development of the times. They have systematically answered the major era - defining question of what kind of socialism with Chinese characteristics to uphold and develop in the new era and how to uphold and develop it through the integration of theory and practice, and thus founded Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era.Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era is the inheritance and development of Marxism - Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thought of "Three Represents" and the Scientific Outlook on Development. It must be adhered to for a long time and continuously developed.Under the guidance of Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, the Communist Party of China has led the people of all ethnic groups in the country to exercise overall leadership over the great struggle, great project, great cause, and great dream, thus pushing socialism with Chinese characteristics into a new era.
The fundamental reason for all the achievements and progress we have made since the reform and opening up can be summarized as: opening up the path of socialism with Chinese characteristics, forming the theoretical system of socialism with Chinese characteristics, establishing the system of socialism with Chinese characteristics, and developing the culture of socialism with Chinese characteristics. Comrades of the entire Party must cherish, persist in, and continuously develop the path, theoretical system, system, and culture that the Party has created through hardships, hold high the great banner of socialism with Chinese characteristics, strengthen confidence in the path, theory, system, and culture, implement the Party's basic theories, lines, and strategies, and strive to achieve the three major historical tasks of advancing modernization, completing national reunification, maintaining world peace, and promoting common development, realizing the "Two Centenary Goals" and realizing the Chinese Dream of the great rejuvenation of the Chinese nation.
Our country is currently in and will remain in the primary stage of socialism for a long time. This is an insurmountable historical stage in the construction of socialist modernization in China, which was originally economically and culturally backward and requires hundreds of years. The socialist construction in our country must start from our national conditions and follow the path of socialism with Chinese characteristics. At present, the main contradiction in Chinese society is the contradiction between the growing needs of the people for a better life and the unbalanced and inadequate development. Due to domestic factors and international influences, class struggle still exists within a certain range for a long time, and may intensify under certain conditions, but it is no longer the main contradiction. The fundamental task of socialist construction in our country is to further liberate and develop productive forces, gradually achieve socialist modernization, and reform the aspects and links of production relations and superstructure that are not suitable for the development of productive forces. We must adhere to and improve the basic economic system with public ownership as the mainstay and multiple forms of ownership developing together, adhere to and improve the distribution system with distribution according to work as the mainstay and multiple distribution methods coexisting, encourage some regions and some people to become rich first, gradually eliminate poverty, achieve common prosperity, continuously meet the growing needs of the people for a better life on the basis of production development and social wealth growth, and promote comprehensive human development. Development is the top priority for our party to govern and revitalize the country. We must adhere to the people-centered development philosophy and the development concept of innovation, coordination, green, openness, and sharing. All work should take the benefits of developing the productive forces of socialist society, enhancing the comprehensive national strength of socialist countries, and improving the living standards of the people as the overall starting point and testing standard. Respect labor, knowledge, talent, and creativity, and achieve development for the people, development relying on the people, and development achievements shared by the people. Entering the new century, China has entered a new development stage of comprehensively building a moderately prosperous society and accelerating the promotion of socialist modernization. We must follow the overall layout of the "Five in One" and the "Four Comprehensives" strategic layout of the socialist cause with Chinese characteristics, coordinate the promotion of economic construction, political construction, cultural construction, social construction, and ecological civilization construction, and promote the comprehensive construction of a moderately prosperous society, the comprehensive deepening of reform, the comprehensive rule of law, and the comprehensive strict governance of the Party. In the new century and era, the strategic goal of economic and social development is to comprehensively build a moderately prosperous society by the 100th anniversary of the founding of the Communist Party of China; By the 100th anniversary of the founding of the People's Republic of China, we will have comprehensively built a socialist modernized strong country.
The basic line of the CPC in the primary stage of socialism is to lead and unite the people of all ethnic groups in the country, focus on economic development, adhere to the Four Cardinal Principles, adhere to reform and opening up, self-reliance, work hard, and strive to build China into a modern socialist power that is prosperous, strong, democratic, civilized, harmonious, and beautiful.
In leading the socialist cause, the CPC must adhere to economic construction as the center, and all other work should be subordinate to and serve this center. To implement the strategies of revitalizing the country through science and education, strengthening the country through talent, innovation driven development, rural revitalization, regional coordinated development, sustainable development, and military civilian integration, fully leverage the role of science and technology as the primary productive force, and innovation as the driving force for development, rely on technological progress, improve the quality of workers, and promote higher quality, more efficient, more equitable, and more sustainable development of the national economy.
The four basic principles of adhering to the socialist road, adhering to the people's democratic dictatorship, adhering to the leadership of the CPC, and adhering to Marxism Leninism and Mao Zedong Thought are the foundation of our country. Throughout the process of socialist modernization construction, we must adhere to the Four Cardinal Principles and oppose bourgeois liberalization.
Persisting in reform and opening up is our path to building a strong country. Only through reform and opening up can China, socialism, and Marxism be developed. We must comprehensively deepen reform, improve and develop the socialist system with Chinese characteristics, and promote the modernization of the national governance system and governance capacity. We must fundamentally reform the economic system that constrains the development of productive forces, and adhere to and improve the socialist market economy system; Correspondingly, political system reform and reforms in other fields should be carried out. We must adhere to the basic national policy of opening up to the outside world and absorb and learn from all the achievements of civilization created by human society. Reform and opening up should boldly explore, courageously explore, improve the scientific nature of reform decisions, pay more attention to the systematic, holistic, and collaborative nature of reform, and create new paths in practice.
The CPC leads the people in developing the socialist market economy. We will unwaveringly consolidate and develop the public sector and encourage, support and guide the development of the non-public sector. Give full play to the decisive role of the market in resource allocation, better leverage the role of the government, and establish a sound macroeconomic regulation system. Coordinate urban and rural development, regional development, economic and social development, harmonious development between humans and nature, domestic development and opening up to the outside world, adjust economic structure, transform economic development mode, and promote supply side structural reform. Promote the synchronous development of new industrialization, informatization, urbanization, and agricultural modernization, build a socialist new countryside, take the path of new industrialization with Chinese characteristics, and build an innovative country and a world science and technology powerhouse.
The CPC leads the people in developing socialist democracy. Adhere to the organic unity of the leadership of the Party, the people being the masters of the country, and the rule of law, take the path of socialist political development with Chinese characteristics, expand socialist democracy, build a socialist rule of law system with Chinese characteristics, construct a socialist rule of law country, consolidate the people's democratic dictatorship, and build socialist political civilization. We will uphold and improve the system of people's congresses, the system of multi-party cooperation and political consultation under the leadership of the CPC, the system of regional ethnic autonomy, and the system of grass-roots mass autonomy. Develop a more extensive, comprehensive, and sound people's democracy, promote the extensive, multi-layered, and institutionalized development of consultative democracy, and effectively safeguard the rights of the people to manage national and social affairs, as well as economic and cultural undertakings. Respect and safeguard human rights. Open up channels of communication, establish and improve systems and procedures for democratic elections, decision-making, management, and supervision. Improve the legal system of socialism with Chinese characteristics, strengthen the implementation of laws, and achieve the legalization of all national work.
The CPC leads the people in developing advanced socialist culture. Building a socialist spiritual civilization, combining the rule of law with the rule of virtue, improving the ideological and moral qualities and scientific and cultural qualities of the entire nation, providing strong ideological guarantees, spiritual motivation, and intellectual support for reform, opening up, and socialist modernization construction, and building a socialist cultural power. Strengthen the construction of the socialist core value system, adhere to the guiding ideology of Marxism, establish the common ideal of socialism with Chinese characteristics, carry forward the national spirit with patriotism as the core and the spirit of the times with reform and innovation as the core, cultivate and practice the socialist core values, advocate the socialist concept of honor and disgrace, enhance national self-esteem, self-confidence and self-improvement, resist the erosion of capitalist and feudal decadent ideas, eliminate all kinds of social evils, and strive to make our people become people with ideals, morality, culture and discipline. Party members should receive education on the lofty ideals of communism. Vigorously develop education, science, and cultural undertakings, promote the creative transformation and innovative development of excellent traditional Chinese culture, inherit revolutionary culture, develop advanced socialist culture, and enhance the country's cultural soft power. We should firmly grasp the leadership of ideological work, constantly consolidate the guiding role of Marxism in the ideological field, and consolidate the common ideological basis for the unity and struggle of the whole party and the whole people.
The CPC leads the people in building a harmonious socialist society. In accordance with the general requirements of democracy and the rule of law, fairness and justice, honesty and friendship, vitality, stability and order, and harmonious coexistence between humans and nature, as well as the principles of common construction and common enjoyment, with the focus on safeguarding and improving people's livelihoods, we will solve the most concerned, direct, and practical issues of the people's interests, so that the development achievements can benefit all people more and fairly, continuously enhance the sense of gain of the people, and strive to form a situation where all people can do their best, get what they deserve, and live in harmony. Strengthen and innovate social governance. Strictly distinguish and correctly handle the two types of contradictions with different natures: the contradiction between the enemy and ourselves and the contradiction among the people. Strengthen comprehensive management of social security, resolutely crack down on various criminal activities and individuals that endanger national security and interests, social stability and economic development in accordance with the law, and maintain long-term social stability. Adhere to the overall national security concept, resolutely safeguard national sovereignty, security, and development interests.
The CPC leads the people in building a socialist ecological civilization. Establish the ecological civilization concept of respecting nature, conforming to nature, and protecting nature, enhance the awareness that green mountains and clear waters are as valuable as mountains of gold and silver, adhere to the basic national policy of conserving resources and protecting the environment, adhere to the principle of prioritizing conservation, protection, and natural restoration, and adhere to the path of civilized development with production development, prosperous life, and good ecology. We will focus on building a resource-saving and environmentally friendly society, implement the strictest ecological environment protection system, form a spatial pattern, industrial structure, production mode, and lifestyle that saves resources and protects the environment, create a good production and living environment for the people, and achieve sustainable development of the Chinese nation.
The Communist Party of China adheres to the absolute leadership over the People's Liberation Army and other people's armed forces, implements Xi Jinping's thinking on strengthening the military, strengthens the building of the People's Liberation Army, adheres to building the military through politics, reform, science and technology, and the rule of law, and builds a people's army that obeys the Party's command, can fight and win, and has fine traditions. It earnestly ensures that the People's Liberation Army effectively fulfills its military missions and tasks in the new era, and gives full play to the role of the People's Liberation Army in consolidating national defense, defending the motherland and participating in socialist modernization drive.
The CPC maintains and develops socialist ethnic relations of equality, solidarity, mutual assistance and harmony, actively trains and selects ethnic minority cadres, helps ethnic minorities and ethnic minority areas develop economic, cultural and social undertakings, casts a strong sense of community of the Chinese nation, and realizes the common unity, struggle, prosperity and development of all ethnic groups. Fully implement the basic principles of the Party's religious work, unite religious believers to contribute to economic and social development.
The CPC, united with workers, farmers and intellectuals of all ethnic groups in the country, and with the patriotic forces of all democratic parties, people without party affiliation and all ethnic groups, will further develop and expand the broadest patriotic united front composed of all socialist workers, builders of the socialist cause, patriots who support socialism, patriots who support the reunification of the motherland and are committed to the great rejuvenation of the Chinese nation. We will continue to strengthen the unity of the people of the whole country, including our compatriots in the Hong Kong Special Administrative Region, the Macao Special Administrative Region, Taiwan and overseas Chinese. Following the principle of 'one country, two systems', promote the long-term prosperity and stability of Hong Kong and Macao, and accomplish the great cause of national reunification.
The CPC adheres to an independent foreign policy of peace, adheres to the path of peaceful development, adheres to the opening strategy of mutual benefit and win-win results, coordinates the domestic and international overall situation, actively develops foreign relations, and strives to strive for a favorable international environment for China's reform, opening up and modernization. In international affairs, we must adhere to the correct view of righteousness and interests, safeguard China's independence and sovereignty, oppose hegemonism and power politics, maintain world peace, promote human progress, promote the construction of a community with a shared future for mankind, and promote the construction of a harmonious world of lasting peace and common prosperity. On the basis of mutual respect for sovereignty and territorial integrity, non aggression, non-interference in each other's internal affairs, equality and mutual benefit, and peaceful coexistence, we will develop our relations with countries around the world. Continuously developing friendly relations with neighboring countries and strengthening solidarity and cooperation with developing countries. Follow the principle of joint consultation, construction and sharing, and promote the construction of the "the Belt and Road". According to the principles of independence, complete equality, mutual respect, and non-interference in each other's internal affairs, we will develop the relationship between our party and communist parties and other political parties in various countries.
To lead the people of all ethnic groups in the country to realize the "Two Centenary Goals" and the Chinese Dream of the great rejuvenation of the Chinese nation, the CPC must closely follow the Party's basic line, adhere to the principle that the Party should manage the Party and exercise strict governance in an all-round way, strengthen the Party's long-term governance capacity, progressiveness and purity, comprehensively promote the new great project of Party building in the spirit of reform and innovation, comprehensively promote the Party's political, ideological, organizational, style and discipline building, and put system building into practice, deepen the fight against corruption, and comprehensively improve the scientific level of Party building. Adhere to the principle of building the Party for the public and exercising power for the people, carry forward the Party's fine tradition and style of work, constantly improve the Party's leadership and governance level, improve its ability to resist corruption and risks, constantly enhance its ability to self purify, self improve, self innovate, and self improve, constantly strengthen the Party's class foundation and expand the Party's mass base, constantly improve the Party's creativity, cohesion, and combat effectiveness, and build a learning, service-oriented, and innovative Marxist ruling party, so that our Party will always be at the forefront of the times and become a strong core to lead the people of the country along the path of socialism with Chinese characteristics. The construction of the Party must resolutely achieve the following five basic requirements:
Firstly, adhere to the Party's basic line. We must unify reform and opening up with the Four Cardinal Principles, fully implement the Party's basic line, oppose all erroneous tendencies of "left" and "right", be wary of the right, but mainly prevent the "left". Strengthen the construction of leadership teams at all levels, cultivate and select good cadres needed by the Party and the people, cultivate and nurture millions of successors to the socialist cause, and ensure the implementation of the Party's basic theories, basic lines, and basic strategies from an organizational perspective.
Secondly, we must adhere to emancipating the mind, seeking truth from facts, keeping pace with the times, and being pragmatic in seeking truth. The ideological line of the Party is to start from reality, connect theory with practice, seek truth from facts, and test and develop truth in practice. The whole party must adhere to this ideological line, actively explore, boldly experiment, innovate, creatively carry out work, constantly study new situations, summarize new experiences, solve new problems, enrich and develop Marxism in practice, and promote the sinicization of Marxism.
Thirdly, we must adhere to serving the people wholeheartedly. The Party has no special interests of its own except for the interests of the working class and the broadest masses of the people. The Party always puts the interests of the masses first, shares joys and sorrows with the masses, maintains the closest connection, adheres to the principle of using power for the people, caring for the people, and seeking benefits for the people, and does not allow any Party member to detach from the masses or surpass them. Our party's greatest political advantage is close ties with the masses, but the biggest danger after the party takes power is detachment from the masses. The issues of Party conduct and the connection between the Party and the people are crucial to the survival of the Party. The Party implements the mass line in its own work, everything for the sake of the masses, everything relies on the masses, comes from the masses, goes to the masses, and turns the Party's correct propositions into conscious actions of the masses.
Fourth, adhere to democratic centralism. Democratic centralism is a combination of centralization based on democracy and democracy guided by centralization. It is not only the fundamental organizational principle of the Party, but also the application of the mass line in the Party's life. We must fully promote intra party democracy, respect the dominant position of party members, safeguard their democratic rights, and unleash the initiative and creativity of party organizations at all levels and the vast number of party members. Strengthen and standardize the political life within the Party, enhance its political, contemporary, principled, and combative nature, develop a positive and healthy political culture within the Party, and create a clean and upright political ecology. The Party carries out criticism and self-criticism correctly in its political life, engages in ideological struggle on principle issues, adheres to truth, and corrects errors. Efforts should be made to create a political situation that is both centralized and democratic, disciplined and free, with a unified will and a relaxed and lively individual mood.
Fifth, we must adhere to strict Party governance. Comprehensively and strictly governing the Party is always on the way. Under the new situation, the Party is facing long-term, complex, and severe challenges in governance, reform and opening up, market economy, and external environment. The dangers of spiritual laziness, insufficient ability, detachment from the masses, and passive corruption are even more acute in front of the entire Party. We must implement strict standards and measures throughout the entire process and all aspects of Party governance. Adhere to governing the Party according to rules and addressing both symptoms and root causes, prioritize discipline, strengthen organizational discipline, and ensure that everyone is equal in the face of Party discipline. Strengthen the main responsibility and supervisory responsibility of Party management and governance, enhance the supervision of the Party's leading organs and Party members, especially the main leading cadres, and continuously improve the Party's internal supervision system. Deepen the construction of Party conduct and clean governance, and fight against corruption, punish corruption with a zero tolerance attitude, and establish an effective mechanism that dares not, cannot, and does not want corruption.
The leadership of the CPC is the most essential feature of socialism with Chinese characteristics and the greatest advantage of the socialist system with Chinese characteristics. The Party leads everything in the fields of party, government, military, civilian, and education, from east to west, north to south, and center. The Party must adapt to the requirements of reform and opening up and socialist modernization construction, adhere to scientific governance, democratic governance, and rule of law governance, and strengthen and improve the Party's leadership. The Party must play a leading core role in various organizations at the same level in accordance with the principle of overall planning and coordination among all parties. The Party must concentrate its efforts on leading economic construction, organizing and coordinating forces from all aspects, working together to carry out work around economic construction, and promoting comprehensive economic and social development. The Party must implement democratic and scientific decision-making, formulate and implement correct lines, principles, and policies, do a good job in Party organization and propaganda and education, and give full play to the exemplary role of all Party members. The Party must operate within the scope of the Constitution and laws. The Party must ensure that the legislative, judicial, administrative, and supervisory organs, economic, cultural organizations, and people's organizations of the country work actively, independently, responsibly, and in a coordinated manner. The Party must strengthen its leadership over trade unions, the Communist Youth League, women's federations and other mass organizations, so that they can maintain and enhance their political, progressiveness and mass character and give full play to their role. The Party must adapt to the development and changes of the situation, improve its leadership system, enhance its leadership style, and strengthen its governance capacity. Communist Party members must closely cooperate with non party members and work together to build socialism with Chinese characteristics.
Chapter 1: Party Members
Article 1 Chinese workers, peasants, soldiers, intellectuals and advanced elements of other social strata who have reached the age of 18, recognize the Party's program and constitution, and are willing to participate in and actively work in one of the Party organizations, implement the Party's resolutions and pay party dues on time may apply to join the CPC.
Article 2 Members of the CPC are vanguard fighters of the Chinese working class with communist consciousness.
Members of the CPC must serve the people heart and soul, sacrifice everything of their own, and strive for the realization of communism all their lives.
Members of the CPC will always be ordinary members of the working people. Except for personal interests and work authority within the scope of laws and policies, all Communist Party members shall not seek any personal gain or privilege.
Article 3: Party members must fulfill the following obligations:
(1) Earnestly study Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thought of "Three Represents", the Scientific Outlook on Development, and Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era; study the Party's lines, principles, policies and resolutions; study the basic knowledge of the Party; study science, culture, law and professional knowledge; and strive to improve the ability to serve the people.
(2) Implement the Party's basic line and various guidelines and policies, take the lead in participating in reform and opening up and socialist modernization construction, drive the masses to work hard for economic development and social progress, and play a pioneering and exemplary role in production, work, study, and social life.
(3) Adhere to the principle that the interests of the Party and the people are paramount, and personal interests are subordinate to the interests of the Party and the people. Endure hardships first, enjoy later, restrain oneself and serve the public, and make more contributions.
(4) Consciously abide by the Party's discipline, first and foremost the Party's political discipline and rules, model compliance with national laws and regulations, strictly guard Party and state secrets, implement Party decisions, obey organizational assignments, and actively complete Party tasks.
(5) Maintain the unity and solidarity of the Party, be loyal and honest to the Party, be consistent in words and deeds, resolutely oppose all factional organizations and small group activities, and oppose the two faced behavior and all conspiracies and tricks.
(6) Effectively carry out criticism and self-criticism, courageously expose and correct words and deeds that violate the principles of the Party, as well as shortcomings and errors in work, and resolutely fight against negative and corrupt phenomena.
(7) Closely connect with the masses, promote the Party's propositions to the masses, consult with the masses when encountering problems, timely reflect the opinions and demands of the masses to the Party, and safeguard the legitimate interests of the masses.
(8) Promote the new socialist trend, take the lead in practicing the socialist core values and socialist concept of honor and disgrace, advocate communist morality, and promote the traditional virtues of the Chinese nation. In order to protect the interests of the country and the people, we stand up bravely in all difficult and dangerous times, fight bravely, and are not afraid of sacrifice.
Article 4: Party members enjoy the following rights:
(1) Attend relevant Party meetings, read Party documents, and receive Party education and training.
(2) Participate in discussions on party policy issues at party meetings and in party newspapers and magazines.
(3) Propose suggestions and initiatives for the work of the Party.
(4) Criticize any organization or member of the Party with a basis at Party meetings, responsibly expose and report any violations of laws and discipline by any organization or member of the Party, demand disciplinary action against Party members who violate laws and discipline, and demand the dismissal or replacement of incompetent cadres.
(5) Exercise the right to vote, the right to vote, and the right to be elected.
(6) When the party organization discusses and decides on disciplinary actions or appraisals against party members, the individual has the right to participate and defend themselves, while other party members can testify and defend them.
(7) If there are different opinions on the Party's resolutions and policies, on the premise of resolute implementation, one can declare reservations and present their own opinions to the Party's higher-level organizations and even the central government.
(8) Submit requests, appeals, and accusations to the higher-level organizations of the Party and the central government, and request responsible responses from relevant organizations.
No level of party organization, up to the central government, has the right to deprive party members of the above-mentioned rights.
Article 5: When developing party members, political standards must be given top priority, and the principle of individual absorption must be adhered to through the party branch.
Applicants for joining the Party must fill out a voluntary application form, have two formal Party members as introducers, pass the approval of the branch meeting and the higher-level Party organization, and undergo a probationary period before becoming a formal Party member.
The introducer should carefully understand the applicant's thoughts, qualities, experiences, and work performance, explain the party's program and constitution to him, explain the conditions, obligations, and rights of party members, and make a responsible report to the party organization.
The Party branch committee should pay attention to soliciting the opinions of relevant masses inside and outside the Party for applicants to join the Party, conduct strict review, and submit them to the branch meeting for discussion only after they are deemed qualified.
Before approving an applicant to join the Party, the higher-level Party organization should send someone to talk to him, further understand him, and help him improve his understanding of the Party.
In special circumstances, the Central Committee of the Party and the committees of provinces, autonomous regions, and municipalities directly under the Central Government may directly accept Party members.
Article 6: Preparatory Party members must take the oath of joining the Party in front of the Party flag. The oath is as follows: I volunteer to join the CPC, support the party's program, abide by the party's constitution, fulfill the party's obligations, implement the party's decisions, strictly abide by the party's discipline, keep the party's secrets, be loyal to the party, work actively, fight for communism all my life, be ready to sacrifice everything for the party and the people, and never betray the party.
Article 7: The probationary period for probationary party members is one year. Party organizations should carefully educate and inspect probationary party members.
The obligations of probationary party members are the same as those of formal party members. The rights of probationary party members are the same as those of regular party members, except for the right to vote, vote, and be elected.
When the probationary period for a probationary party member expires, the party branch should promptly discuss whether he can be converted into a formal party member. Those who conscientiously fulfill their obligations as party members and meet the conditions for party membership should be converted to formal party members on schedule; For those who need further investigation and education, the preparatory period can be extended, but not exceeding one year; Those who fail to fulfill their obligations as party members and do not meet the conditions for party membership shall have their probationary party membership revoked. The conversion of probationary party members to formal party members, or the extension of probationary period, or the cancellation of probationary party member qualifications, shall be discussed and approved by the branch meeting and the higher-level party organization.
The probationary period for a probationary party member shall be counted from the date when he is approved as a probationary party member by the branch meeting. The party membership of a party member shall be counted from the date of conversion from probationary period to formal party member.
Article 8: Every party member, regardless of their position, must be incorporated into a branch, group, or other specific organization of the party, participate in the organizational life of the party, and accept supervision from the masses inside and outside the party. Party members and leading cadres must also participate in the democratic life meetings of the Party committee and the Party group. No special party members are allowed who do not participate in the organizational life of the party or accept supervision from the masses inside and outside the party.
Article 9: Party members have the freedom to resign from the Party. If a party member requests to resign from the party, the expulsion shall be announced after discussion at the branch meeting and reported to the higher-level party organization for the record.
Party members lack revolutionary will, fail to fulfill their obligations as Party members, and do not meet the conditions for Party membership. The Party branch should educate them and require them to make corrections within a specified period of time; If there is still no change after education, he should be advised to quit the party. Encouraging party members to resign from the party should be discussed and decided at the branch meeting, and approved by the higher-level party organization. If a party member who is advised to quit the party insists on not quitting, they should submit it to the branch meeting for discussion, decide to expel them, and report to the higher-level party organization for approval.
If a party member fails to participate in the party's organizational life, pay party dues, or do the work assigned by the party for six consecutive months without justifiable reasons, it is considered to have left the party on their own. The branch meeting should decide to expel such party members and report to the higher-level party organization for approval.
Chapter 2: Organizational System of the Party
Article 10: The Party is a unified entity organized according to its own program and constitution, based on democratic centralism. The basic principle of the Party's democratic centralism is:
(1) Individual Party members shall obey the Party organization, the minority shall obey the majority, lower level organizations shall obey higher-level organizations, and all Party organizations and Party members shall obey the National Congress and the Central Committee of the Party.
(2) The leading organs of the Party at all levels, except for the representative organs dispatched by them and the Party groups in non Party organizations, are elected.
(3) The highest leading organ of the Party is the National Congress of the Party and the Central Committee it produces. The local leadership organs of the Party at all levels are the Party's local congresses and the committees formed by them. The party committees at all levels are responsible to and report their work to the congress at the same level.
(4) The higher-level organizations of the Party should regularly listen to the opinions of lower level organizations and Party members and masses, and promptly solve the problems they raise. The lower level organizations of the Party should not only seek approval and report their work to the higher-level organizations, but also independently and responsibly solve problems within their scope of responsibilities. The upper and lower level organizations should exchange intelligence, support each other, and supervise each other. Party organizations at all levels should implement transparency in Party affairs in accordance with regulations, so that Party members have a better understanding and participation in Party affairs.
(5) The Party committees at all levels implement a system that combines collective leadership with individual division of labor and responsibility. All major issues must be discussed and decided collectively by the Party committee in accordance with the principles of collective leadership, democratic centralism, individual deliberation, and conference decision-making; Committee members should fulfill their responsibilities effectively based on collective decisions and division of labor.
(6) The party prohibits any form of personality cult. To ensure that the activities of Party leaders are under the supervision of the Party and the people, while maintaining the credibility of all leaders representing the interests of the Party and the people.
Article 11: The election of representatives and committees of the Party's congresses at all levels shall reflect the will of the electors. The election will be conducted through anonymous voting. The candidate list should be fully discussed and deliberated by the party organization and the voters. The formal election can be conducted directly using the difference in the number of candidates compared to the number of candidates to be elected. Alternatively, the differential election method can be used for preliminary selection to generate a list of candidates, followed by formal elections. Voters have the right to understand the situation of candidates, demand changes in candidates, not choose any candidate, and choose another person. No organization or individual shall force voters to elect or not elect any individual in any way.
If there is a violation of the Party Constitution in the election of local and grassroots Party congresses, the higher-level Party committee shall, after investigation and verification, make a decision to invalidate the election and take corresponding measures, and report it to the higher-level Party committee for review and approval, and officially announce and implement it.
The representatives of the Party's congresses at all levels shall implement a term system.
Article 12: The central and local committees of the Party shall convene representative meetings when necessary to discuss and decide on major issues that need to be resolved in a timely manner. The number and method of selecting representatives for the representative conference shall be decided by the committee that convenes the representative conference.
Article 13: Any establishment of a new party organization or revocation of an existing party organization must be decided by the higher-level party organization.
During the recess of local and grassroots party congresses, higher-level party organizations may, when deemed necessary, transfer or appoint leaders of lower level party organizations.
The central and local committees of the Party may dispatch representative organs.
Article 14: The Central Committee of the Communist Party of China and the committees of provinces, autonomous regions, and municipalities directly under the Central Government shall implement an inspection system, and within one term of office, achieve full coverage of inspections of the party organizations of the localities, departments, enterprises, and institutions under their management.
The Party committees of relevant central ministries and state organs shall carry out inspection work according to work needs.
The Party's city (prefecture, state, league) and county (city, district, banner) committees shall establish a patrol system.
Article 15: When making decisions on important issues related to subordinate organizations, the leading organs of the Party at all levels shall, under normal circumstances, solicit the opinions of subordinate organizations. To ensure that subordinate organizations can exercise their powers normally. For issues that should be handled by subordinate organizations, unless there are special circumstances, the higher-level leadership should not intervene.
Article 16: Regarding major national policy issues, only the Central Committee of the Communist Party of China has the power to make decisions. Party organizations in various departments and localities may make suggestions to the Central Committee, but may not make decisions or express opinions to the outside world without authorization.
The lower level organizations of the Party must resolutely implement the decisions of the higher-level organizations. If the subordinate organization believes that the decision of the superior organization does not conform to the actual situation of the region or department, it can request a change; If the superior organization insists on the original decision, the subordinate organization must implement it and may not publicly express different opinions, but has the right to report to the higher-level organization.
The newspapers, magazines, and other propaganda tools of Party organizations at all levels must promote the Party's line, principles, policies, and resolutions.
Article 17: Party organizations must adhere to the principle of the minority obeying the majority when discussing and deciding on issues. Decisions on important issues require a vote. Different opinions from a minority should be carefully considered. If there is a dispute over an important issue and the number of people on both sides is close, except in emergency situations where the majority opinion must be followed, the decision should be postponed, further investigation and research should be conducted, opinions should be exchanged, and the next vote should be taken; In special circumstances, disputes can also be reported to higher-level organizations for arbitration.
If a party member represents the party organization and makes important statements that exceed the scope of the party organization's existing decisions, they must submit them to the party organization they belong to for discussion and decision-making, or seek approval from higher-level party organizations. No party member, regardless of their position, can make personal decisions on major issues; In case of emergency, when a decision must be made by an individual, it is necessary to promptly report to the party organization afterwards. No leader is allowed to exercise personal dictatorship or elevate individuals above the organization.
Article 18: The central, local, and grassroots organizations of the Party must attach great importance to Party building, regularly discuss and inspect the Party's propaganda work, education work, organizational work, discipline inspection work, mass work, united front work, etc., and pay attention to studying the ideological and political situation inside and outside the Party.
Chapter 3: The Central Organization of the Party
Article 19: The National Congress of the Party shall be held every five years and convened by the Central Committee. If the Central Committee deems it necessary, or if more than one-third of provincial-level organizations request, the National Congress may be held in advance; Unless there are exceptional circumstances, the event cannot be postponed.
The number of representatives and election methods for the National Congress shall be determined by the Central Committee.
Article 20: The powers of the National Congress of the Communist Party of China are:
(1) Listen to and review the report of the Central Committee;
(2) Review the report of the Central Commission for Discipline Inspection;
(3) Discuss and decide on major issues of the Party;
(4) Amend the Party Constitution;
(5) Election of the Central Committee;
(6) Election of the Central Commission for Discipline Inspection.
Article 21: The powers of the National Congress of the Communist Party of China are: to discuss and decide on major issues; Adjust and elect some members of the Central Committee and the Central Commission for Discipline Inspection. The number of adjustments and additions to the Central Committee and alternate Central Committee members shall not exceed one-fifth of the total number of Central Committee members and alternate Central Committee members elected by the National Congress of the Communist Party of China.
Article 22: The term of office of the Central Committee of the Party is five years. If the National Congress is held earlier or postponed, its term of office will change accordingly. Members and alternate members of the Central Committee must have at least five years of party membership. The number of members and alternate members of the Central Committee shall be determined by the National Congress. Vacancies in the Central Committee shall be filled by alternate members of the Central Committee in order of the number of votes received.
The plenary session of the Central Committee is convened by the Political Bureau of the Central Committee and held at least once a year. The Central Political Bureau reports its work to the plenary session of the Central Committee and accepts supervision.
When the National Congress is not in session, the Central Committee implements the resolutions of the National Congress, leads all the work of the Party, and represents the CPC externally.
Article 23: The Political Bureau of the Central Committee of the Communist Party of China, the Standing Committee of the Political Bureau of the Central Committee, and the General Secretary of the Central Committee shall be elected by the plenary session of the Central Committee. The General Secretary of the Central Committee must be elected from among the members of the Standing Committee of the Political Bureau of the Central Committee.
The Central Politburo and its Standing Committee exercise the powers of the Central Committee during the recess of the plenary session of the Central Committee.
The Central Secretariat is the administrative body of the Political Bureau of the Central Committee and its Standing Committee; The members are nominated by the Standing Committee of the Political Bureau of the Central Committee and approved by the plenary session of the Central Committee.
The General Secretary of the Central Committee is responsible for convening meetings of the Central Political Bureau and the Standing Committee of the Central Political Bureau, and presiding over the work of the Central Secretariat.
The members of the Central Military Commission of the Communist Party of China are determined by the Central Committee, and the Central Military Commission implements a system of chairman responsibility.
The central leadership institutions and leaders elected by each Central Committee shall continue to preside over the regular work of the Party during the next National Congress until a new central leadership institution and leader are elected by the next Central Committee.
Article 24 The Party organizations of the Chinese People's Liberation Army carry out their work in accordance with the instructions of the Central Committee. The Central Military Commission is responsible for the Party work and political work in the armed forces and formulates regulations on the organizational system and institutions of the Party in the armed forces.
Chapter 4: Local Organizations of the Party
Article 25: The Party's congresses of provinces, autonomous regions, municipalities directly under the Central Government, cities with districts and autonomous prefectures, counties (banners), autonomous counties, cities without districts, and municipal districts shall be held once every five years.
The local Party congresses at all levels are convened by the Party committees at the same level. In special circumstances, with the approval of the higher-level committee, it may be held in advance or postponed.
The number of representatives and election methods for local Party congresses at all levels shall be decided by the Party committee at the same level and submitted to the higher-level Party committee for approval.
Article 26: The powers of local Party congresses at all levels are:
(1) Listen to and review reports from peer committees;
(2) Review the report of the disciplinary inspection committee at the same level;
(3) Discuss major issues within the local area and make resolutions;
(4) Elect the same level party committee and the same level party discipline inspection committee.
Article 27: The term of office of the Party's committees in provinces, autonomous regions, municipalities directly under the Central Government, cities divided into districts, and autonomous prefectures is five years. Members and alternate members of these committees must have at least five years of party membership.
The committees of the Party's counties (banners), autonomous counties, cities without districts, and municipal districts shall serve a term of five years each. Members and alternate members of these committees must have at least three years of party membership.
If the Party's local congresses at all levels are held in advance or postponed, the term of office of the committees elected by them shall be correspondingly changed.
The number of members and alternate members of the Party's local committees at all levels shall be determined by the higher-level committee. Vacancies among members of local party committees at all levels shall be filled by alternate members in order of the number of votes received.
The plenary sessions of the Party's local committees at all levels shall be held at least twice a year.
During the recess of the congress, the local party committees at all levels shall implement the instructions of the higher-level party organizations and the resolutions of the same level party congress, lead the work of their respective areas, and regularly report their work to the higher-level party committees.
Article 28: The plenary session of the Party's local committees at all levels shall elect the Standing Committee, Secretary, and Deputy Secretary, and report to the higher-level Party committee for approval. The standing committees of local Party committees at all levels shall exercise their powers during the recess of the committee's plenary session; During the next session of the congress, continue to preside over regular work until a new standing committee is formed.
The standing committees of local party committees at all levels shall regularly report their work to the plenary session of the committee and accept supervision.
Article 29: The Party's regional committees and organizations equivalent to regional committees are representative organs dispatched by the Party's provincial and autonomous region committees in several counties, autonomous counties, and cities. It leads the work in this region according to the authorization of the provincial and autonomous region committees.
Chapter 5: Grassroots Organizations of the Party
Article 30: Enterprises, rural areas, government agencies, schools, research institutes, street communities, social organizations, People's Liberation Army companies, and other grassroots units with three or more formal party members shall establish grassroots party organizations.
Grassroots Party organizations, based on work needs and the number of Party members, shall establish Party grassroots committees, general branch committees, and branch committees with the approval of higher-level Party organizations. Grassroots committees are elected by the Party members' congress or representative congress, while general branch committees and branch committees are elected by the Party members' congress. When proposing candidates for committee members, the opinions of Party members and the masses should be widely solicited.
Article 31: The term of office for the Party's grassroots committees, general branch committees, and branch committees is three to five years. After the election of the secretaries and deputy secretaries of grassroots committees, general branch committees, and branch committees, they should be submitted to the higher-level party organization for approval.
Article 32: The grassroots organizations of the Party are the fighting fortresses of the Party in the grassroots organizations of society, and the foundation of all the Party's work and combat effectiveness. Its basic task is:
(1) Promote and implement the Party's line, principles, and policies, publicize and implement the resolutions of the Party Central Committee, higher-level organizations, and our own organization, fully leverage the exemplary role of Party members, actively strive for excellence, unite and organize cadres and masses inside and outside the Party, and strive to complete the tasks undertaken by our unit.
(2) Organize Party members to earnestly study Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thought of "Three Represents", the Scientific Outlook on Development, and Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era; promote the normalization and institutionalization of the "Two Studies and One Action" study and education; study the Party's lines, principles, policies and resolutions; study the basic knowledge of the Party; and study scientific, cultural, legal and professional knowledge.
(3) To educate, manage, supervise, and serve party members, improve their quality, strengthen their ideals and beliefs, enhance their party spirit, strictly manage the organizational life of the party, carry out criticism and self-criticism, maintain and enforce party discipline, supervise party members to fulfill their obligations effectively, and safeguard the rights of party members from infringement. Strengthen and improve the management of mobile party members.
(4) Maintain close contact with the masses, regularly understand their criticisms and opinions on Party members and Party work, safeguard their legitimate rights and interests, and do a good job in ideological and political work for the masses.
(5) Give full play to the enthusiasm and creativity of Party members and the masses, discover, cultivate, and recommend outstanding talents among them, encourage and support them to contribute their intelligence and talents in the reform and opening up and socialist modernization construction.
(6) Educate and cultivate active members who are required to join the Party, do a good job in regularly developing Party members, and attach importance to developing Party members in the front line of production, work, and among young people.
(7) Supervise Party members, cadres, and any other staff to strictly abide by national laws and regulations, financial and economic regulations, and personnel systems, and not to encroach on the interests of the state, collectives, and the masses.
(8) Educate Party members and the masses to consciously resist negative tendencies and resolutely fight against various violations of discipline and law.
Article 33: The grassroots party committees of streets, townships, and towns, as well as village and community party organizations, shall lead the work and grassroots social governance in their respective areas, support and ensure that administrative organizations, economic organizations, and mass autonomous organizations fully exercise their powers.
The Party committee (Party group) of state-owned enterprises plays a leading role in setting direction, managing the overall situation, ensuring implementation, and discussing and deciding major issues of the enterprise in accordance with regulations. Grassroots Party organizations in state-owned and collective enterprises carry out work around enterprise production and operation. Ensure the implementation and supervision of the Party and state's policies and guidelines in this enterprise; Support the shareholders' meeting, board of directors, supervisory board, and manager (factory director) to exercise their powers in accordance with the law; Wholeheartedly rely on the masses of workers and support the work of the workers' congress; Participate in decision-making on major issues of the enterprise; Strengthen the self construction of party organizations, lead ideological and political work, spiritual civilization construction, and mass organizations such as trade unions and the Communist Youth League.
The grassroots organizations of the Party in non-public economic organizations implement the Party's policies and guidelines, guide and supervise enterprises to comply with national laws and regulations, lead trade unions, Communist Youth League and other mass organizations, unite and unite workers, safeguard the legitimate rights and interests of all parties, and promote the healthy development of enterprises.
The grassroots organizations of the Party in social organizations promote and implement the Party's line, principles, and policies, lead trade unions, Communist Youth League and other mass organizations, educate and manage Party members, lead and serve the masses, and promote the development of the cause.
Grassroots Party organizations in public institutions that implement the system of administrative leadership responsibility should play a role as a fighting fortress. In public institutions that implement the administrative leadership responsibility system under the leadership of the Party committee, grassroots Party organizations discuss and make decisions on major issues, while ensuring that administrative leaders fully exercise their powers.
Grassroots Party organizations at all levels of Party and state organs shall assist administrative leaders in completing tasks, improving work, educating, managing, and supervising every Party member, including administrative leaders, and shall not lead the business work of their own units.
Article 34: Party branches are the basic organizations of the Party, responsible for directly educating Party members, managing Party members, supervising Party members, organizing the masses, promoting the masses, uniting the masses, and serving the masses.
Chapter 6: Party Cadres
Article 35: Party cadres are the backbone of the Party's cause and the public servants of the people. They must be loyal, clean, and responsible. The Party selects cadres based on the principle of both moral integrity and professional competence, with moral integrity as the top priority. We adhere to the principle of appointing people based on their abilities, prioritize our cause, uphold fairness and integrity, oppose nepotism, and strive to achieve a revolutionary, youthful, knowledgeable, and professional cadre team.
The Party attaches great importance to education, training, selection, assessment, and supervision of cadres, especially in cultivating and selecting outstanding young cadres. Actively promote the reform of the cadre system.
The Party attaches great importance to cultivating and selecting female cadres and ethnic minority cadres.
Article 36: Leading cadres at all levels of the Party must have firm beliefs, serve the people, be diligent and pragmatic in governance, dare to take on responsibilities, be honest and upright, and exemplarily fulfill the obligations of Party members as stipulated in Article 3 of this Constitution. They must also meet the following basic conditions:
(1) Having the ability to apply Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thought of "Three Represents," and the Scientific Outlook on Development as required for performing their duties; taking the lead in implementing Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era; striving to analyze and solve practical problems using Marxist standpoints, viewpoints, and methods; adhering to emphasizing study, politics, and integrity; and being able to withstand the test of various storms.
(2) Having a firm belief in the lofty ideals of communism and socialism with Chinese characteristics, resolutely implementing the Party's basic line and various guidelines and policies, aspiring to reform and open up, dedicating oneself to the cause of modernization, working hard in socialist construction, establishing a correct view of political achievements, and making achievements that can withstand the test of practice, the people, and history.
(3) Adhere to emancipating the mind, seeking truth from facts, keeping pace with the times, exploring and innovating, conducting careful investigation and research, being able to combine the Party's principles and policies with the actual situation of the region and department, effectively carrying out work, telling the truth, doing practical things, and seeking practical results.
(4) Has a strong sense of revolutionary cause and political responsibility, practical experience, organizational ability, cultural level, and professional knowledge to be competent in leadership work.
(5) Correctly exercise the power entrusted by the people, adhere to principles, act in accordance with the law, be honest and clean, be diligent in serving the people, lead by example, work hard and plain, closely connect with the masses, adhere to the Party's mass line, consciously accept criticism and supervision from the Party and the masses, strengthen moral cultivation, emphasize Party spirit, conduct, set an example, achieve self-respect, self reflection, self vigilance, and self motivation, oppose formalism, bureaucracy, hedonism, and extravagance, and oppose any abuse of power or pursuit of personal gain.
(6) Adhere to and uphold the Party's democratic centralism, have a democratic style, a global perspective, and be good at uniting comrades, including working together with comrades who have different opinions.
Article 37: Party members and cadres should be good at cooperating and working with non party cadres, respect them, and humbly learn from their strengths.
Party organizations at all levels should be good at discovering and recommending non Party cadres with real talents and practical knowledge to serve as leaders, ensuring that they have positions and rights, and fully exerting their roles.
Article 38: Leading cadres at all levels of the Party, whether elected democratically or appointed by leadership organs, shall not hold permanent positions and may be subject to change or dismissal.
Cadres whose age and health conditions are not suitable for continuing to work should retire or retire in accordance with national regulations.
Chapter 7: Party Discipline
Article 39: Party discipline is a set of behavioral rules that Party organizations at all levels and all Party members must abide by, and is a guarantee for maintaining Party unity and completing Party tasks. Party organizations must strictly implement and maintain Party discipline, and Communist Party members must consciously accept the constraints of Party discipline.
Article 40: Party discipline mainly includes political discipline, organizational discipline, integrity discipline, mass discipline, work discipline, and life discipline.
Adhere to the principle of learning from the past and avoiding the future, treating illnesses and saving lives, strictly enforce discipline, and hold those who violate rules accountable. Take early and early measures to address minor issues, prevent small problems from escalating, and give criticism and education until disciplinary action is taken according to the nature and severity of the mistakes. Using the "four forms" of supervision and discipline, making "blushing and sweating" the norm, disciplinary actions and organizational adjustments have become important means of managing the Party. Party members who seriously violate discipline or criminal laws must be expelled from the Party.
The Party strictly prohibits the use of means that violate the Party Constitution and national laws to treat Party members, and strictly prohibits retaliation, false accusations, and framing. Organizations or individuals who violate these regulations must be held accountable by the Party's discipline and national laws.
Article 41: There are five types of disciplinary sanctions against party members: warning, serious warning, revocation of party positions, probation within the party, and expulsion from the party.
Stay under party observation for a maximum of two years. Party members do not have the right to vote, vote, or be elected during their probationary period. Party members who have undergone probation and have corrected their mistakes should have their party membership rights restored; Those who persist in their mistakes and do not correct them shall be expelled from the Party.
Expulsion from the party is the highest punishment within the party. When party organizations at all levels decide or approve the expulsion of party members, they should comprehensively study relevant materials and opinions and adopt a very cautious attitude.
Article 42: Disciplinary actions against Party members must be discussed and decided upon at the branch meeting and submitted to the Party's grassroots committee for approval; If the issues involved are important or complex, or if a party member is subject to expulsion from the party, they should be reported to the county-level or higher-level party discipline inspection commission for review and approval according to different situations. In special circumstances, party committees and disciplinary inspection commissions at or above the county level have the right to directly decide to impose disciplinary sanctions on party members.
Members and alternate members of the Central Committee of the Communist Party of China shall be given warnings or severe disciplinary actions, which shall be reviewed by the Standing Committee of the Central Commission for Discipline Inspection and submitted to the Party Central Committee for approval. Members and alternate members of local party committees at all levels shall be given warnings or serious disciplinary actions, which shall be approved by the higher-level disciplinary inspection commission and reported to the same level party committee for record.
Members and alternate members of the Central Committee of the Communist Party of China and local committees at all levels shall be subject to disciplinary actions such as revocation of their party positions, probation within the party, or expulsion from the party, which must be decided by a two-thirds majority of the plenary session of the committee to which they belong. During the recess of the plenary session, the Central Political Bureau and the standing committees of local committees at all levels may first make a decision on the handling, which shall be ratified when the plenary session of the committee is convened. The above-mentioned disciplinary actions against members and alternate members of local committees at all levels must be reviewed by the standing committee of the higher-level disciplinary inspection commission and submitted to the same level party committee for approval by the disciplinary inspection commission at that level.
Central Committee members and alternate members who seriously violate criminal laws shall be expelled from the Party by the decision of the Central Political Bureau; Members and alternate members of local committees at all levels who seriously violate the criminal law shall be expelled from the party by the standing committee of the same level committee.
Article 43: Party organizations shall truthfully investigate the facts when making disciplinary decisions against Party members. The factual materials on which the disciplinary decision is based and the disciplinary decision must be presented in person to listen to my explanation of the situation and defense. If I am not satisfied with the disciplinary decision, I can file an appeal, and the relevant party organization must be responsible for handling or promptly forwarding it, and shall not withhold it. For those who persist in erroneous opinions and unreasonable demands, criticism and education should be given.
Article 44: If a party organization fails to uphold party discipline, it must be held accountable.
For party organizations that seriously violate party discipline and cannot be corrected themselves, the higher-level party committee shall, after investigation and verification, make a decision to reorganize or dissolve them according to the severity of the circumstances, and report it to the higher-level party committee for review and approval, and officially announce its implementation.
Chapter 8: Disciplinary Inspection Organs of the Party
Article 45: The Central Commission for Discipline Inspection of the Party shall carry out its work under the leadership of the Central Committee of the Party. The local disciplinary inspection committees and grassroots disciplinary inspection committees of the Party work under the dual leadership of the same level Party committee and the higher-level disciplinary inspection committee. The higher-level Party discipline inspection committee strengthens its leadership over the lower level discipline inspection committee.
The term of office of the disciplinary inspection committees at all levels of the Party is the same as that of the Party committees at the same level.
The plenary session of the Central Commission for Discipline Inspection of the Party elects the Standing Committee, Secretary, and Deputy Secretary, and submits them to the Central Committee of the Party for approval. The plenary session of the local disciplinary inspection committees of the Party elects the Standing Committee, Secretary, and Deputy Secretary, and is approved by the Party committee at the same level and submitted to the higher-level Party committee for approval. Whether to establish a disciplinary inspection committee or a disciplinary inspection committee at the grassroots level of the Party shall be decided by the higher-level Party organization according to specific circumstances. The Party's general branch committee and branch committee shall have disciplinary inspection commissioners.
The central and local disciplinary inspection commissions of the Party shall comprehensively dispatch Party disciplinary inspection teams to Party and state organs at the same level. The leader of the discipline inspection team attends relevant meetings organized by the Party leadership of the stationed department. Their work must be supported by the leadership organization of the party in the organization.
Article 46: The disciplinary inspection commissions at all levels of the Party are the specialized organs for Party supervision, with the main tasks of safeguarding the Party's Constitution and other Party regulations, inspecting the implementation of the Party's line, principles, policies, and resolutions, assisting Party committees in promoting comprehensive strict governance of the Party, strengthening Party conduct construction, and organizing and coordinating anti-corruption work.
The responsibilities of the disciplinary inspection committees at all levels of the Party are supervision, discipline enforcement, and accountability. They should regularly educate Party members on abiding by discipline and make decisions on maintaining Party discipline; Supervise the performance of duties and exercise of power by Party organizations and Party member leaders, accept and handle reports and grievances from Party members and the masses, and conduct talks, reminders, and interview letters; Inspect and handle relatively important or complex cases where the Party organization and Party members violate the Party Constitution and other Party regulations, and decide or cancel the punishment of Party members in these cases; Make recommendations for accountability or accountability; Accepting complaints and appeals from party members; Protect the rights of party members.
Disciplinary inspection commissions at all levels shall report the problems and results of handling particularly important or complex cases to the party committee at the same level. The local disciplinary inspection committees and grassroots disciplinary inspection committees of the Party shall simultaneously report to the higher-level disciplinary inspection committees.
Disciplinary inspection committees at all levels may conduct preliminary verification if they discover that members of the same level party committee have violated party discipline. If it is necessary to file a case for inspection, they should report to the higher-level disciplinary inspection committee at the same time as reporting to the same level party committee; For matters involving standing committee members, a report shall be submitted to the higher-level disciplinary inspection commission for preliminary verification. If review is required, the higher-level disciplinary inspection commission shall report to its party committee at the same level for approval.
Article 47: The higher-level disciplinary inspection commission has the power to inspect the work of the lower level disciplinary inspection commission, and has the power to approve and change the decisions made by the lower level disciplinary inspection commission on cases. If the decision of the lower level disciplinary inspection commission to be changed has already been approved by its party committee at the same level, such changes must be approved by its higher-level party committee.
If the local disciplinary inspection committees and grassroots disciplinary inspection committees of the Party have different opinions on the decisions of the same level Party committee in handling cases, they may request the higher-level disciplinary inspection committee to conduct a review; If it is found that the same level party committee or its members have violated party discipline, and the same level party committee does not provide a solution or does not provide a correct solution, they have the right to appeal to the higher-level disciplinary inspection committee and request assistance in handling it.
Chapter 9 Party Group
Article 48 Party groups may be established in the leadership organs of central and local state organs, people's organizations, economic organizations, cultural organizations, and other non party organizations. The Party group plays a leading core role. The task of the Party group is mainly to implement the Party's line, principles, and policies; Strengthen the leadership of party building in our unit and fulfill the responsibility of comprehensively governing the party strictly; Discuss and decide on major issues of our unit; Do a good job in cadre management; Discuss and decide on important matters such as adjusting the establishment of grassroots party organizations, developing party members, and punishing party members; Unite non party cadres and the masses to complete the tasks assigned by the Party and the state; The work of party organizations in leadership organs and directly affiliated units.
Article 49: The members of a Party group shall be decided by the Party organization that approves the establishment of the Party group. The Party group shall have a secretary and, if necessary, a deputy secretary.
The Party group must obey the leadership of the Party organization that approves its establishment.
Article 50: State work departments that implement centralized and unified leadership over their subordinate units may establish party committees. The methods for the formation, powers, and work tasks of party committees shall be separately prescribed by the central government.
Chapter 10: The Relationship between the Party and the Communist Youth League
Article 51 The Communist Youth League of China is a mass organization of advanced young people led by the CPC, a school for young people to learn socialism with Chinese characteristics and communism in practice, and an assistant and reserve force of the Party. The Central Committee of the Communist Youth League is under the leadership of the Party Central Committee. The local level organizations of the Communist Youth League are led by the same level party committee and also by the higher-level organizations of the Communist Youth League.
Article 52: Party committees at all levels shall strengthen their leadership over the Communist Youth League and pay attention to the selection and training of league cadres. The Party must firmly support the Communist Youth League in carrying out its work in a lively and creative manner based on the characteristics and needs of the vast number of young people, fully leveraging the role of the Youth League as a shock brigade and a bridge connecting with the vast number of young people.
The secretaries of the county-level and below level committees of the Youth League, as well as the secretaries of the Youth League committees of enterprises and institutions, who are party members, may attend meetings of the same level Party committees and standing committees as non voting delegates.
Chapter 11 Party Emblem and Flag
Article 53 The party emblem of the CPC is a pattern composed of a sickle and a hammer.
Article 54 The party flag of the CPC is a red flag with a golden party emblem on its surface.
Article 55 The party emblem and flag of the CPC are the symbols and symbols of the CPC. All levels of Party organizations and every Party member must uphold the dignity of the Party emblem and flag. Make and use the Party emblem and flag in accordance with regulations.
